1. Privacy Statement

The protection of your personal data is very important to us. Therefore we process your data exclusively on the basis of the legal regulations (GDPR, TKG 2003). In this privacy policy we inform you about the most important aspects of data processing within our website.

MoBerries GmbH (“MoBerries”) is an Internet platform with the purpose of operating a web portal in the field of job recommendations to job seeking candidates. Any collection, processing and use (hereinafter referred to as “use”) of data are exclusively done for the provision of our services. MoBerries sets the highest requirements on data protection and privacy. MoBerries’s services have been designed to protect personal data as comprehensively as possible. In this context, “personal data” means all individual details of personal or factual circumstances of a particular or identifiable natural person (the so-called “affected person”). No transfer of such data for other marketing purposes or sales takes place in any case.

The following remarks on data privacy describe what kind of data we use from you, for what purpose this is happening and what we do with your data.

4. Used Data

When you create a profile on www.moberries.com, we use data that may also be personal in order to provide our service.

If you register as a candidate at MoBerries and create a profile, then we use the following data, which may also be personal:

  • First and last name
  • E-mail address
  • Your CV as a file. This can contain all the information you want to share with an employer in case of application.
  • Information about desired occupation and professional experience
  • Linguistic proficiency
  • Current place of residence
  • Salary expectations
  • readiness to relocate
  • Career level
  • Type of desired location
  • Qualifications and knowledge
  • Communication via MoBerries Platform messenger

This data is used to mediate to employers registered on our platform. Employers will only be able to access your data if you actively apply for the specific job or accept a job proposal from MoBerries. The data you provide will be stored, processed and transmitted to the employer by MoBerries. The transmission is always encrypted via TLS (Transport Layer Security, also known as SSL).

If you register as an employer with MoBerries and create a company profile, then we use the following data, which may also be personal:

  • First and last name
  • E-mail address
  • Telephone number
  • Company name

In your user account, you can enter additional data that may be personal. These include your company logo, corporate photos, company description. These data are stored and published on their company profile on MoBerries.

If you do not use your profile, your data will be deleted or anonymized after one year.

Provision of paid services

In order for us to provide paid services, we ask additional data. This applies to the details of payment.

5. On what legal basis is this privacy statement based on?

The legal basis for the processing of your personal data is Art. 6 (1) (b) GDPR.

6. Where is the data processed?

The data are processed exclusively in data centers of the Federal Republic of Germany.

7. Your rights as “person concerned”

You have the right to information about the personal data we process about you.

In the case of a request for information that is not made in writing, we ask for your understanding that we may then request proof from you that you are the person for whom you are claiming to be.

Furthermore, you have the right to rectification or deletion or restriction of processing, as far as you are legally entitled.

Furthermore, you have the right to object to the processing within the scope of the legal requirements. The same applies to a right to data portability.

8. In general no disclosure of personal data

Unless otherwise stated in these data protection notices, your personal data will not be disclosed to third parties unless you have expressly given your consent or we are obliged to surrender, for example due to a court order or an official order.

9. Data transfer to other countries

In order to match job opportunities to candidates, MoBerries uses third-party service providers. To enable MoBerries to perform its service, you agree that MoBerries provides all necessary information on data processing to tech platforms and service providers in other countries. You are aware of the fact that there may be lower requirements on data protection in other countries than in states of the European Union. Also personal data may be transmitted for the purposes of matching and job placement.

10. Protection of your data

We have taken technical and organizational measures to ensure that the provisions of the Federal Data Protection Act (BDSG) and of the GDPR are observed both by us and by external service providers who work for us.

If MoBerries cooperates with other companies, such as email and server providers, to provide its services, then this is being established after an extensive selection process. In this process, each service provider got carefully selected for meeting our standards in terms of technical and organizational data privacy. This selection procedure will be documented in writing and a contract processing contract (AV contract) will be concluded.

Your data is stored on specially protected servers. Access to these systems is only provided to a few specially authorized persons. If you transmit data to us via our platform, the transmission of data is always taking place via an encrypted connection (128-bit TLS).

11. Cookies

Cookies are small text files, which can be placed on the hard disk of the visitor of a website and enable visitors to be recognized when returning. Cookies are used by MoBerries to analyze and optimize the use of the platform in an anonymous or pseudonymized form. The use of MoBerries is possible without cookies, but the functionality will be limited in certain areas.

Most browsers are set to accept cookies automatically. In general, you can prevent the storage of cookies on your hard disk by selecting “Do not save cookies” in your browser settings. You can also set your browser to ask you if you agree before setting cookies. Finally, you can also delete any cookies once set. To find out how to implement these settings, please refer to your browser’s instructions.

12. Google Analytics

Our website uses Google Analytics. This is a service for traffic monitoring on Google Inc.’s Internet pages (“Google”) and allows us to improve the services of our Internet platform. Through so-called cookies, these are small text files on your computer, the analysis of your use of MoBerries’s service is made possible. The information collected (IP address, access time, access duration) is transferred to a US based Google server and stored there. The evaluation of the activities on our website is communicated to us in the form of reports. Google may pass on the collected information to third parties if law requires this or if third parties process data on behalf of Google. The Google tracking codes of our website use functions to exclude a possible direct personal relationship with you. You can also disable the installation of Google Analytics cookies by setting your browser software accordingly. In this case, however, you may not be able to fully utilize all the functions of our website.

Also the use of browser extensions (e.g. http://tools.google.com/dlpage/gaoptout?hl=en), can disable Google Analytics and control the usage. By using our Internet site, you agree to the processing of your data collected by Google.

13. Newsletter

To receive the newsletter, you must activate the newsletter upon registration. By activating / subscribing to the newsletter, your e-mail address will be used for your own advertising purposes. You will receive the newsletter until you unsubscribe from the newsletter. The deregistration is possible at any time.

If you no longer wish to receive the newsletter, you can unsubscribe using the link at the bottom of each newsletter or in the settings in your profile.

14. Integration of services and content of third parties

Our offer sometimes includes content, services and services of other providers. These are, for example, maps provided by Google Maps, videos from YouTube as well as graphics and images from other websites. In order for these data to be accessed and displayed in the user's browser, the transmission of the IP address is absolutely necessary. The providers (hereinafter referred to as “third-party provider”) thus perceive the IP address of the respective user.

Although we endeavor to use only third-party providers who only need the IP address to deliver content, we have no control over whether the IP address may be stored. This process is used in the case, inter alia, statistical purposes. If we are aware that the IP address is being stored, we will inform our users.

15. Rights of information and opposition, data protection inquiries

You can request detailed information about the data stored about your person at any time - free of charge and without delay. In addition, you have the right at any time to object the further use of your personal data and to demand the deletion, blocking or correction of your data.

In the case of a request for information, you must provide sufficient information about your identity to provide valid proof that the information is about you. You can request information related to data stored about you, the origin and transfer of data and the purpose of the storage.
